These Terms of Service outline your responsibility while using iMoto, a service provided by Welborn Technology LLC.
Notice for Arbitration: You agree that any arbitration will be handled by you and us and waive your right to a class action lawsuit.

iMoto
The mission of iMoto is to provide users the experience of an online racing community. We would like this platform to help riders and track owners communicate in a way not available before, with a platform dedicated to Motocross Racing.

Funding
In order to pay for the computing resources needed for this service, when you sign up for iMoto you agree to be shown ads that pay us to fund the service.

User Responsibilities
iMoto would like everyone to be able to use the service, but in order to maintain a safe and lawful service, users must commit to some restrictions.

• Users must be 13 years or older.
• Users must not be prohibited from using any part of iMoto by law.
• Users must not have been previously banned from using the service.
• Users must not be a convicted sex offender.
• Users cannot impersonate others.
• Users cannot do any illegal activities on the service.
• Users cannot disrupt the service, for example reporting comments or posts for no legitimate reason.
• Users cannot use automated technologies to interact with the app.
• Users cannot post or use others personal information without their consent.
• Users cannot post copyrighted content without consent from the owner.
• You cannot reverse engineer, create works derived from, or modify our products.
• You must have written consent from iMoto to attempt to extract or decompile out source code.

Permissions you give iMoto
Your content and images remain yours, but you grant iMoto a license to use it. When you upload content to the service, you grant us a transferable, sub-licensable, non-exclusive, royalty-free license to host, distribute, and display this uploaded content. You agree that iMoto can download and update the application.

Removing Content

• You agree that any content that violates these terms of service can and will be removed.
• We can stop providing the service to you in order to remain lawful or to maintain our service’s standards.
• If a user requests removal of information via imotoracing.com (Contact Us), we will begin this process in 45 days. This process may take up to 4 months.
• A user’s content will not be deleted if another user has used the content under this license.
• A user’s content will not be deleted if it is needed to investigate illegal activity.
• A user’s content will not be deleted if it will compromise the security or functionality of the software or systems.
• A user’s content will not be deleted if it is needed as evidence.
• A user’s content will not be deleted if it is requested by law enforcement or other government authority.
• If we or you delete your account, these terms terminate.

Agreements by iMoto

• If any part of this agreement is not enforceable, the rest of the agreement remains valid.
• A waiver or amendment must be signed by us, if any aspect of this agreement is failed to be enforced it is not a waiver.
• We reserve all of the rights not expressly granted to the user.
• Given a dispute, past, present, and current associates of this service can reserve our rights under this agreement. Other than this, this agreement does not give rights to third parties.
• Users cannot transfer their obligations or rights without our written consent.
• If ownership changes, these obligations and rights can be assigned to others.
• The service is provided ‘as is’ and is not guaranteed to be secure, safe, or work all of the time.
• We are not responsible for what users post or do.
• Our liability is limited as much as allowed by law, we will not be responsible for lost data, information, or revenue.

Terms of Service Updates
These Terms of Service may be revised or changed to reflect our policies. If you continue to use the service, you agree to the updated Terms of Service. If you do not agree to the new Terms of Service then you can delete your account at imotoracing.com on the Contact Us page.
